Chattanooga, Tennessee Tuesday July 9th 1878.  Hon. John B. Hoyt Judge presiding.

The Grand Jurors entered into Open Court a bill of Indictment against the Defendent for Malicious Shooting.  Entered a true bill Larkin Hair foreman of the Grand Jury.  Which indictment and ??? are in the words and figures following

to wit:

 

State of Tennessee, Hamilton County, Circuit Court  July Seven 1878

 

The Grand Jurors for the State aforesaid, being duly Summoned, elected, impanneled, Sworn and charged to inquire for the County aforesaid, upon their oaths present that Robert Davis on the 1st day of July, 1878 in the County aforesaid did unlawfully, feloniously and maliciously shoot Yank Clift against the peace and dignity of the State.

Endorsed, Indictment The State vs. Robert Davis, Malisious Shooting.  Wm. Carson Prosecutor  Witness Wm.Carson witness for State.  Sworn before ?? to testify the 8th day of July, 1878.  Larkin Hair, Foreman.

And the Defendant being brought to the box of the Court in the custody of the Sherriff and the defendant in default of bail is remanded to jail

The State vs. Robert Davis

Malicious Shooting

 

Came the Atty Genl who prosecutes for the State and the Defendant being brought to the box of the Court in the custody of the Sheriff who being arraigned and charged for plea says he is not guilty in manner and form as charged and for his trial puts himself upon the County and the Atty Genl to do the like.

Thereupon this cause is continued by consent until the next term of this Court.  The Defendant is allowed to give bond in the sum of five hundred dollars with ??? security.  And the Defendant with his Securities Sallie E. Garrabrant and Reuben Gibson and acknowledged them selves indebted to the State of Tennessee that is to say the said Robert Davis in the sum of five hundred dollars and his said Securities jointly and severally in the sum of  five hundred dollars to be void on condition the said Robert Davis appears before this Court when setting for the County of Hamilton at the Courthouse in Chattanooga the Second Monday in November nex then and there to answer a charge of the State of Tennessee exhibited against him by Indictment for Malicious Shooting and not depart the Court without leave.

The Court then adjourned until tomorrow morning 8 o'clock.

Malicious Shooting

 

This cause is continued till next term of this Court for want of a competent court and the defendant in open Court with J. A. Allen and J. C. Potter his securities and acknowledged them sevles indebted to the State of Tennessee that is to say the said R. N. Davis in the sum of Five hundred dollars and the said Securities jointly and severally in the sum of Five hundred Dollars to be void on condition the said R. N. Davis appear before this Court when held for the County of Hamilton at the Court House in Chattannoga on the second Monday in March next then and there to answer a Charge exibited  (as written)against him for Malicoius Shooting and not dispose the Court  without leave.

By consent the trial of this cause is continued until Thursday next the 27th day of March 1879.

Came the Attorney General who prosecutes for the state and also came the Defendant in person thereupon

this cause is continued on affidavit of the Defendant until the next term of this court.  Then upon came James  M. Varnus and James Cummings his securities in open court and acknowledged themselves indebted to the State of Tennessee that is to say the said R. N. Davis in the sum of Five Hundred dollars and the  securities jointly and severally in the sum of Five Hundred dollars to be void on condition the said R. N. Davis appears before this court when sitting for the County of Hamilton at the Court house in the city of Chattanooga on the first Monday after the second Monday in July next to answer a charge of the State of Tennessee exhibited against him by Indictmant for Malicious Shooting and not depost the Court without leave.

This day came into open court Susan Walker and Jane Walker witnesses for the State and acknowledged

themselves indebted to the State in the sum of Two Hundred and fifty Dollars each to be void on condition

that the said Witnesses appear before this court when sitting for the County of Hamilton at the Court house in the City of Chattanooga on the first Monday after the second Monday in July next then and there to give evidence on behalf of the State against the Defendant for Malicious Shooting and not depost the Court without leave.
