It appearing to the Court that the defendant Nasa Fitzgerald, is a non-resident of this state so that the ordinary process of the court cannot be served upon him.  It is therefore ordered by the court that publication for four weeks be made in the Chattanooga Rebel, a newspaper published in the city of Chattanooga, notifying the said defendant to appear at the next term of the Circuit Court to be held at the court

House in Harrison, on the third Monday of November 1863, and plead answer of demur to the plaintiff’ saction, or judgment by default will be offered, and the cause set for hearing expartes.
