This indenture made and entered into
between Elizabeth Davis of the one part and Wesley Davis of the other
part that the said Elizabeth Davis has this day sold and transferred to
the said Wesley Davis all the right and title myself and my heirs has of
in and to an undivided track of land belonging to the heirs of James
Davis Sr. Deceased. Containing
one hundred and sixty area lying and being in the County of Hamilton and
the State of Tennessee on the waters of Long Savannah, Ocoee District
Second Range west of the Basis line, Third Township and the south
section being the south east quarter of said section my undivided
interest to the said tract of land supposed to be five acres more or
less to have and to hold the same to the said Wesley Davis, his heirs
and assigns forever and, I the said Elizabeth Davis do convent with the
said Wesley Davis that I am lawfully seized of said land by heir ship
and have a right to convey and the same is unencumbered.
I do further convent and bind myself my heirs and representatives
to warrant and forever defend the title to the said Wesley Davis.
And further that the said Wesley Davis has paid me the sum of
Fifty Dollars for said land I do further covenant to the said Wesley
Davis his heirs and assigns against the lawful claims of all and every
person or persons whatever this 7th day of August 1856. Elizabeth
